Real Estate Agents Act 2008 (REAA)

The Real Estate Agents Act 2008 was passed in September 2008 and will replace the Real Estate Agents Act 1976 with a new regulatory regime for real estate agents, branch managers and salespersons.

November 17 sees the introduction of a very important piece of NZ legislation affecting the Real Estate Industry, and one that all NZ citizens should be thanking the Government for!

It is not often that the Government gets too many plaudits for introducing new or amended legislation, but in this case it should (no the new ACT isn't perfect but it's an improvement on the previous landscape).

Just knowing this legislation was coming would have rocked some operators and hopefully will see "those socks being pulled up" for our clients and the industry.

The 2008 Real Estate Agents Act has two very simple aims.

1. To induce more transparency in Real Estate dealings and

2. To give further protection to the consumer in Real Estate transactions

Was it needed, should be the first question.

In most cases this answer will be quite simply no.

Many who have been selling Real Estate for some time have been very aware and great practitioners, of true and effective customer service. Many of the leading Agencies have significant programmes in the training of such.

So why was the new Act introduced?

The Act was seen to be necessary to ensure that those not described by the previous statement, now have a framework to either work within, or in the very poor cases, be caught out by.

The majority of the content of the 2008 Act achieves what it set out to do, and as the introduction highlighted, New Zealand home sellers and buyers should now expect and be given, the very best standards of customer service when transacting a property.
